Section 8 Formation

Charitable trusts can be established in three ways:

  • Registering a trust under the Indian Trusts Act (register with the Sub-Registrar’s Office)
  • Registering as a society under the State Co-operative Societies Act
  • Incorporating a company under the Companies Act, 2013, commonly known as a ‘Section 8’ company.

A Section 8 Company can be registered if it fulfills the following conditions:

  • The company’s objective is to promote commerce, art, science, sports, education, research, social welfare, religion, charity, protection of the environment, or any other similar purpose.
  • The company intends to apply its profits, if any, or other income solely for promoting its stated objectives.
  • The company intends to prohibit the payment of any dividend to its members.
